    Thinking on High-quality Intellectual Property Development of CNPC Against New Situation

    Scientific and technological innovation is becoming an important engine for global economic development. Intellectual property has become an important system to inspire scientific and technological innovation and protect the results of scientific and technological innovation in various countries. China National Petroleum Corporation (CNPC) attached great importance to IP work and experienced four stages in this area – preliminary stage, stable development, rapid development and high-quality development. It has established the “1+3+N” IP organizational system and management system and made remarkable achievements in the areas of IP evaluation work, report on IP launching and analysis for the major scientific and technological projects and patent rewarding. As of the end of 2022, CNPC saw more than 35,000 items of effective patents with the patents for invention occupying over 46 percent of the total. The patent applications exceeded 6800 items in 2022 while the patent applications for invention accounted for more than 96 percent and the PTC patent applications surpassed 130 items. Facing the new situation, CNPC came up with the higher requirements on IP work in the pursuit of building itself into the world’s first-class international integrated energy company. The IP work should be place on the daily agenda of scientific and technological innovation and building the company into an innovation-typed enterprise. It is necessary to create some patents of “powerful influence”. CNPC will be committed to high-quality IP creation, high-value application, high-efficiency protection and high management level at the next stage and substantially promote development of high-quality professionals so that intellectual property can be used to support and guide technological innovation.

    How to position intellectual property value by an enterprise is an issue of vital importance for the enterprise to bring about IP value. This paper focuses on the currently existing problems to some extent, such as generalization of IP conception and value differentiation as well as the actual condition that the main value part becomes multi-element. It also tries to clearly define the main value part, value objective part and value source of a company’s intellectual properties. Using the conception of system, the paper analyzes the corporate IP value positioning, realization paths and elemental structure in such areas as the whole of system, its structure and function, its reliability and its adaptation to the environment. It analyzes positioning and realization paths of key IP value by enterprises of the different types according to corporate market positioning, technology positioning and development objectives. It is proposed that the enterprise should determine the key IP value according its own market positioning, technology positioning and development objectives, optimize the IP system structure by targeting at the best efficiency and performance, and focus on the key parts with concentrated advantageous resources to support the main work of business development and technological innovation.

    Aiming at high-level scientific and technological independence and self-reliance, PetroChina Tarim Oilfield Company made the study of an in-depth integration between full life cyclic management of scientific and technological innovation and intellectual property. It focused on a series of problems, such as inadequately closed relations between intellectual property and technological innovation, inadequate efforts for development and distribution and low conversion efficiency, and committed itself to tapping, developing and distributing high-value patents over the full life cycle of the technological projects. Based on analysis of the cases, this paper proposes that intellectual property should play a driving role in the complete process of technological innovation, namely the “front-end driving” at the time of launching technological research projects, the “middle-end driving” in the execution process of projects, and “the “rear-end drive” at the time to examine and accept projects. It is necessary to establish the active work model for the whole process management. The concrete measures for dynamic and fine management of the full IP life cycle include internal examination and approval of patent submissions, quantified evaluation of classified management, importance attached to control over confirmation process of rights to improve the quality of the authorized patents, and establishment of the information archives for the authorized patents to quantify evaluation of classified management. Currently, Tarim Oilfield has completed the IP development plan for the key technologies in two professional orientations of core technology and two important technological projects, and established the patent cluster (group) with a multi-dimensional protection system composed of patents, software copyrights and technological secrets.
    Thinking and Practice of Intellectual Property Development in Coordination with Scientific and Technological Innovation

    The research institutes at the grassroots level are the main bodies of scientific and technological innovation and technological progress. The Clean Fuels Laboratory of PetroChina Petrochemical Research Institute, strengthened its intellectual property work while accelerating scientific and technological innovation. It focused on a series of problems, such as the failure to distribute IP desirably and in time, inappropriate understanding of IP and inadequate effort for tapping, and emphasizing the technological value of IP but neglecting its law value. To settle those problems, the laboratory developed a set of IP protection and management systems suitable for the research units at the grassroots level and going through the whole technological R&D process. The efforts also included analysis of the present IP conditions and distribution at the preliminary stage of innovation, sustainable IP distribution in improvement of technological R&D activities, unified planning, prevention of risks for applied patents, consolidation of professional staff, and personnel training and standardization of the process system. Remarkable achievement were made in practice of coordinating scientific and technological innovation with IP development. The Clean Fuels Laboratory now owned 124 items of licensed patents, thus effectively promoting scientific and technological innovation and conversion of the results.
    Intellectual Property in Harmony, Protection and Promotion of High-quality Drilling Liquid Industrial Chain Development

    With oil and gas exploration and development unfolded continually and extensively, there are more and more wells of complicated layers, wells of complicated structure and horizontal wells with super-large displacement. Therefore, the market demand for high-performance drilling liquid technology is on the rise. Comparing with the international advanced technology, Greatwall Drilling Co., Ltd. highlighted the intellectual property “family-technology-product” principle and formulated a three-level IP protection wall strategy on the basis of the “protection type, confrontation type and stockpiling type” IP distribution. Based on a “technology-patent-standard” integration, the company established, step by step, the patent groups of the full industrial chain of GWHP-FLEX? technological family, accompanied with registration of software authorship and registration of trade marks, to fully protect the relative patent technology of amine prohibitor and its amine drilling fluid system as well as its extended patent technology. The company successfully eliminated the foreign IP barriers and effectively helped the technology converted to create economic results on the domestic and overseas markets, such as in Chad and Niger as well as Xuyong shallow-layer shale gas in Sichuan. Therefore, the company has brought the whole drilling fluid industrial chain under high-quality development.

    Based on the important R&D projects of the nation and CNPC, CNPC Engineering Technology R&D Company Limited has made its intellectual property (IP) distribution in steps with its R&D project and carried out the high-quality IP incubation projects in recent years. It was committed to the efforts to perfect management mechanism, improve management level and accelerate IP distribution while adopting the measures for strengthening management and training, deepening promotions and guidance, promoting incubation and transformation, and focusing on good performance and results. Therefore, the number of patents was gradually on the rise with the structure increasingly optimized, displaying the research institute’s international R&D advantages. It also benchmarked against the advanced technologies both at home and abroad, systematically clarified and planned the orientations for incubation of key IP results, and enhanced the efforts for creation and stockpile of the independent intellectual properties in the key areas. Meanwhile, the research institute established a number of high-value IP groups, such as coiled tubing and service technology, AnyCem automatic cementing technology and equipment, and tailored PDC drilling bit. Each item of technology came under protection through establishment of IP groups, registration of software authorship and authentication of the technological secrecy. Those measure effectively improved independent innovation ability and key competitiveness of engineering technology, thus leading the nation in the direction of engineering technology development.

    Closely following the new development orientation in recent year, the ethylene team of China National Petroleum Corporation (CNPC) has successfully developed the million-ton ethylene production technology through ethane cracking, the complete set of technology for large-scale production of ethylene from complex raw materials, high-efficiency ethylene energy-saving technology and carbon reduction technology. The key technological indexes of each process reaches the international advanced level with some processes becoming the world leaders . To protect the core competitiveness of its independently-owned technologies, the company formulated the plan for construction of the ethylene patent group and made clarification and distribution of the relative patent applications of all kinds. It strengthened the efforts for patent analysis and intellectual property risks warning and gradually established the wide-coverage and effectively-protected ethylene technology patent group through continuous development, application and maintenance. CNPC has realized industrial transformation of its large-scale ethylene cracking technology patent, which was successfully used in 22 ethylene construction and renovation projects. In addition, the technology was further upgraded and optimized according the customers’ demand in the process of its promotion and application, forming the healthy and sustainable development path for its independently-owned technology and providing the cases to study the development model for integration of intellectual property with scientific and technological innovation.

    Patent navigation is an indispensable and important tool for an enterprise to improve its R&D capability and strategic distribution of technology. It is also of realistic significance to the enterprise for scientific allocation of innovation resources. However, the enterprise is usually short of the necessary understanding of the patent operation specifications and fails to take hold of the key points. Moreover, it doesn’t have the measures for effective management and application of the follow-up results, affecting the final results of patent navigation. Taking patent navigation of geophysical benchmark controllable seismic source high-effective acquisition technology for example, this paper explains the requirements on the processes of corporate patent navigation basis, launch of projects, execution of projects, production of results and application of results. It also analyzes the issues existing in the key links of patent navigation execution process, such as selection of areas, organization and division of labor, and catalogue strategy, and optimizes intellectual property protection after production of results. The system is established to make self-inspection and preliminary examination before submission of the patent, adopt a “five-level examination” and classification in the application process, and act as agent for patent management and evaluation after submission of the applications, ensuring the key technologies to come under all-around and high-quality protection. Those measures provide the references for the guidance work at next step and perfection of the relative patent management system.

    Protection of patents is of the regional character. To boost the patent value, Research Institute of Natural Gas Technology of PetroChina Southwest Oil & Gasfield Company carried out the strategy for distribution of key patents both as home and abroad and strengthened patent protection and utilization. Distribution in the patent-applying nation should take into account three dimensions – protection, stockpiling and confrontation. It is necessary to give priority to the nations radiated by distribution of overseas market. Then the nations with the market to be opened will be selected. Finally, it is necessary to consider the main business areas of competitors. Research Institute of Natural Gas Technology analyzed and summarized the technological advantages in the areas of chemicals for oil and gas field development, corrosion evaluation and control, natural gas purification and utilization, and natural gas measurement, and strengthened patent distribution of the relative products as well as standardized inspection technology and devices. Based on technological benchmarking and determination of the key invention points, the research institute selected some key technologies to form the key high-value patents. As for overseas patent distribution for two items of technology – amine reactivation technology and gas chromatography separation technology, the research institute analyzed the technological advantages, determined the key patents, overseas markets and patent-applying nations, improved the quality of patent text, distributed the patents indispensable for international standards, and strengthened construction of technology, patent and standard interaction system for innovation, thus helping the enterprises with their high-quality development.
    Chuanqing’s Patent Strategy and Practice of Precise Managed Pressure Drilling Technology

    To break the foreign technology monopoly and meet the demand of domestic oil and gas exploration and development, CNPC Chuanqing Drilling Engineering Co Ltd started to make a special study of precise managed pressure drilling technology in 2007. After the research efforts of more than 10 years, the company became an innovative leader in this area. From the angle of patent strategy, it focused on patent creation, application and protection while making an active study of design and implementation model and path of patent strategy in the precise managed pressure drilling area. A series of measures were taken for guidance and distribution of patent, creation of patent, protection of patent, and construction of risks management system, thus effectively preventing and avoiding the risks for patent infringement. Chuanqing Drilling Engineering Co Ltd has acquired 17 patents in the area of precise managed pressure drilling technology (including one in the United States and another in Russia) and seven software authorships and formulated 14 items of technological standards. In addition, the technology was put into large-scale application in oil and gas exploration and development of complicated deep layers both at home and abroad for more than 500 well times, such as Jidong Oilfield,Sichuan? and? Chongqing? areas, Tarim Oilfield and the Right Bank of Amu Darya in Turkmenistan. With implementation of the patent strategy, the company forced the foreign important competitors to withdraw from the Chinese market and successfully established its presence on overseas markets by means of its technological advantages and service trade, providing an edge tool for the enterprises to go abroad for effective exploration and development of ultra-deep layers.
    Construction of Intellectual Property Management System for Oilfield Enterprises Against New Situation

    To carry out high-quality intellectual property work, inspire innovation vitality and protect and use innovation results, PetroChina Liaohe Oilfield Company has adhered to the principles of reform and innovation and the mindsets of patenting technology, standardizing the patents and internationalizing the standards. It strengthened integration of intellectual properties with technological research and made the IP distribution in the light of technological innovation focusing on settlement of problems at the time of launching the projects and identifying the problems. The oilfield focused on the advantageous and characteristic technologies and new energy technological area to study the IP guidance and clarified the orientation for high-quality IP creation. It also intensified the process management, continued to construct the system of IP policies and rules, perfected the incentive mechanism and bring the precise incentive conductor into full play. Meanwhile, the oilfield spared no efforts to promote IP conversion and application, encouraged the affiliates to achieve economic results both inside and outside the oilfield, continually strengthened construction of the IP talent system, created a good atmosphere for IP creation and protection, and gradually improved the scale and abilities of professional talents.     Digital transformation has become the main trend owing to flourishing development of global digital economy. In its preliminary stage, Kunlun Digital Technology Co., Ltd. faced a series of challenges, such as an imperfect intellectual property (IP) management system, inadequate awareness of technological innovation and protection, and lack of correct IP understanding. To promote scientific and technological innovation and improve key competitiveness, Kunlun Digital Technology Co., Ltd. actively accelerated reform of IP management and developed a set of new models suitable for IP management during the transition period. It strengthened construction of the management system and promoted development of technological innovation in combination with intellectual properties. The concrete measures included establishment and perfection of the IP management system, construction of the three-level IP organizational system, fostering of IP talents, bringing the whole process of the project under IP management, innovation of IP tapping and distribution models, and configuration of effective IP management platform. Those measure were successfully used in the practice of management. Dream cloud platform made some actual achievements in protection of the innovative results with the IP quality and quantity rising substantially. The company’s IP work was set on the track of healthy and quick development, effectively supporting technological innovation and maintaining a sustainable development of the main businesses for the company.

    Changqing Oilfield faces a series of problems of inadequate integration between technological research and intellectual properties, inadequate awareness of intellectual properties, and shortage of high-quality professionals. To solve those problems, the oilfield is committed to create a good IP atmosphere, foster the IP professional talents, optimize the patent quality control process and construct the high-quality IP development system. The main measures include strengthening IP promotions, perfecting the incentive and awarding system, stepping up training of professional skilled talents, improving the writing ability for technological description, and matching the important positions and key projects with professionals. It is also necessary to promote combination of scientific research projects with intellectual properties, enhance patent quality control, and improve the quality of patent application writing papers. Development, guidance, tapping and distribution of high-quality and highly-valued patents will provide a powerful support for improvement of the company’s key competitiveness and influential power.
    Analysis and Enlightenment of Patents Awarded with China Patent Award

    To motivate the enterprises to strengthen efforts for scientific and technological innovation and promote high-quality and high-value intellectual property creation, this paper focuses on the patents awarded with China Patent Award from the 22nd to the 24th sessions and makes analysis of them from a multiple of dimensions, such as types of patents, regional distribution, industrial areas, number of claims, patent date, and number of patents in the same family. Among the patents awarded with the prize, the number of the enterprises is the highest and then followed by the number of the universities and research institutes. As for regional distribution, Beijing Municipality and Guangdong Province are apparently superior in terms of the number of the awarded patents. The patents from the emerging industry awarded with the golden award and silver award are gradually on the rise, accounting for about 80 percent at the latest three sessions. The patents awarded with China Patent Award from CNPC are accumulated to 22 items for the latest three sessions, mainly distributed in the areas of oil and gas exploration and development, drilling and completion, manufacturing of tubulars, and lubricating oil. The patents awarded with the golden awards and silver awards totaled 269 items for the latest three sessions, of which 65 percent see the number of patent claims to range from five to 15 items. There are 127 items of patents with a period of only two to three years between the patent date and the prize-awarding date, accounting for 47 percent of the total. All the awarded patents have the patent families. There are 151 items with the number of the patents in the same family being no more than two items, accounting for 56 percent of the total. Based on CNPC’s plan for scientific and technological innovation and intellectual property development, this paper proposes to make an in-depth study of the detailed rules for evaluation of China Patent Award and its guidance, strengthen the efforts for high-quality IP development in the areas of oil and gas exploration and development as well as refined oil, promote effective IP production of new energy and new materials, and accelerate conversion of IP results for high economic performance and high-effective operation.
    Performance and Thinking of Fostering Intellectual Property Professional Talents for Enterprises

    Intellectual property talent is the first resource for development of IP business. It is also the precondition for high-quality IP development. Currently, enterprises usually face a series of problems, such as inadequate number of IP professional talents, unreasonable structure, imperfect talent-fostering system, and imperfect incentive mechanism. In recent years, PetroChina Petrochemical Research Institute has fostered a large number of IP professional talents for the enterprises by means of the measures to optimize and perfect the system of IP management rules, enhance IP promotions and training, establish the IP talent-fostering system that is based on “selection, fostering, use and development,” and construct the high-standard IP work platform. A total of more than 50 people at the research institute are qualified as the national patent agents. The IP work covers examination of patent application quality, processing of patent information and construction of databank, patent warning and analysis of infringement, evaluation of patent value and strategic study, and IP training as well as IP analysis and appraisal. Based on the new situation, development of IP professional talents should be focused on the areas of new materials and hydrogen energy. It is necessary to intensify the efforts for development of IP engineers for the enterprises, helping them with the R&D activities and ensuring conversion of technological results.

    Evaluation of patent value is an important work for an enterprise to bring the patent assets under effective management. Summing up the advantages and disadvantages of the existing Chinese and foreign patent value evaluating methods, CNPC Economics & Technology Research Institute established a system of methods to evaluate the effective patent value for petroleum enterprises in the light of the technological characteristics of the petroleum industry and the patent management trends of petroleum enterprises. Based on the characteristics of the oil and gas industrial chain, this paper analyzes the different ways to realize patent value in exploration and development, engineering technology, oil refining and chemicals, safety and environmental protection as well as other areas. The analysis covers corporate strategy, assurance of technology for free application, controlling power of technology, protection of products or serving the market, restriction of competitive rivalries and increase of service added-value. The evaluation indexes, evaluation standards and evaluation weight are established on the basis of the four dimensions – law, technology, application and corporate strategy. The different evaluation norms are formulated according to the different evaluation purposes, thus providing the applicable and quantitative integrated evaluation methods, processes and tools to evaluate the effective patent value and making the optimized suggestions on patent value-evaluating work for petroleum enterprises. The efforts also include establishment and perfection of the information platform for corporate patent value evaluation, introduction of machines for study and evaluation in time, and dynamic perfection of the evaluation system against the energy transitional background.

    As one of China’s backbone energy enterprises, China National Petroleum Corporation (CNPC) made an active study of patent quality improvement to accelerate the company’s high-quality development. In reference to “Circular on ranking of central enterprises for patent conditions” issued by State-owned Assets Supervision and Administration Commission between 2018 and 2020, this paper adopts simulation calculation to construct the corporate patent quality evaluation model with the help of the Delphi method and analytical hierarchy process. Setting the weight of parameters scientifically, it uses the model for benchmarking analysis of the CNPC patent quality work in 2022 and established a three-dimensional all-around configuration of patent protection. To improve the patent quality sustainably, this paper also comes up with a series of suggestions, such as perfecting the regulations and rules for patent management, consolidating intellectual property management institutions, strengthening intellectual property promotions, accelerating intellectual property operation, making the study of patent quality improvement, and constructing the evaluation model to bring about precise management.
