“一带一路”国际能源项目PPP 合作模式探究

摘要: :“一带一路”沿线能源储量丰富,与我国有较强的能源互补性,但沿线能源建设受政治格局、 经济水平、资金技术限制,整体开发水平低。基于政府与社会资本合作(PPP)模式特点,将其引入沿线 能源国际合作领域,推动沿线能源建设,深化我国多边国际能源合作。介绍了国内外能源PPP 模式研究 与合作现状,分析了“一带一路”背景下开展国际能源PPP 合作的参与主体及其相互复杂关系,选取5 个 分别位于缅甸、柬埔寨、巴基斯坦及孟加拉国的“一带一路”典型国际能源PPP 项目进行研究,提出了 基于项目性质与引入要素类别的PPP 运作模式选择、项目基本及超额收益分配机制、风险分担框架与流 程机制及由争端处理程序、争端解决平台及多层次争端解决体系构成的争端处理系统设计构想。为切实保 障能源PPP 项目合作顺利高效实施,从国家层面加强顶层设计、社会资本层面提升参与国际项目实力方 面提出了具体建议。

Abstract: The energy reserves are abundant on the route of “One Belt One Road”, reciprocating with China in terms of energy. However, development in this area remains unsatisfied because energy construction on the route is affected by political situation, economic level and bottlenecks of fund and technology. The PPP model, which is based on the public-private partnerships, will be introduced into international energy cooperation in the countries on the route to promote their energy construction and enhance China’s multilateral international energy cooperation. This paper makes briefings about the current research and cooperation situation of the energy PPP model both inside and outside China and analyzes the main participants and their complication relations in international energy PPP cooperation against the “One Belt One Road” background. Five typical “One Belt One Road” international energy PPP projects, located in Myanmar, Cambodia, Pakistan and Bangladesh, are brought under study. A number of designing schemes are put forward for the model, such as selecting the PPP operational model according to properties of projects and classification of introduced elements, the mechanism for distribution of the project’s basic and abnormal returns, the risk-sharing framework with the process mechanism and dispute-handling procedures, the dispute-settling platform and the dispute-handling system composed of multilevel dispute-settling sub-systems. To ensure effective execution of the energy PPP cooperation projects, the concrete proposals are made in top design at the national level and improvement of the capacity for involvement of social capital into international projects.
