油气矿业权内部流转实践及完善矿权管理机制探讨

摘要: 2025—2027年,国内油气企业矿业权面临新一轮20%的刚性退减,这将影响油气增储上产的资源基础,迫切需要开展矿业权流转管理策略研究,提升油气企业的保供能力。通过分析中国石化内部的矿业权流转实例,总结流转过程中的经验教训,研究加快油气企业间油气矿业权流转的运行机制。系统梳理了国内油气矿业权管理的相关规定,明确油气矿业权企业间流转具有出售、合资、合作3种方式,油气企业间通过合资、合作开展矿业权流转,是解决目前油气矿业权管理困境的有效方式。目前,油气矿业权企业间流转主要存在竞争性出让不能有效弥补油气矿业权急剧缩减、新一轮优质矿权退减将会影响储量产量增长等问题,建议:国家出台配套支持政策,加快推进油气矿业权企业间流转,促进矿业权人参与低勘探程度区块流转积极性;加快推进矿业权竞争性出让和协议出让,增加市场矿业权供应总量;完善企业间油气矿业权流转制度,激发市场活力。

Abstract: The mineral rights of the domestic oil and gas enterprises will be reduced by 20 percent between 2025 and 2027. This will affect the resource base for increasing the oil and gas reserves and production. It is necessary to study the management policies of mineral right transfer to improve the capacity of oil and gas enterprises to secure energy supplies. Based on analysis of the cases of mineral right transfer among Sinopec enterprises, this article summarizes the experience and lessons in the transferring process and studies the operational mechanism to accelerate mineral right transfer among the oil and gas enterprises.It also makes a systematic analysis of the related regulations for domestic oil and gas mineral right management and clarifies three ways of sales, joint venture, and cooperation for mineral right transfer among the oil and gas enterprises. Mineral right transfers among the oil and gas enterprises by means of joint venture and cooperation is an effective way to solve the difficulties in oil and gas mineral right management at present. However, some problems exist in the oil and gas mineral right transfers among the enterprises, such as competitive transfers unable to effectively make up for substantial reduction of the area of oil and gas mineral right and a new round of reduction for the high-quality mineral right likely to affect the growth in reserves and production. Consequently, it is proposed that the state should introduce the related preferential policies to accelerate mineral right transfer among the oil and gas enterprises, motivate mineral right holders to participate in the transfer of the low-degree exploration blocks, promote competitive transfer and cooperative transfer of mineral right, increase the total amount of mineral right supplied on the market, and perfect the system of mineral right transfer among the oil and gas enterprises to enhance the market vitality.
